1. Ordering and Stock Availability 1.1. All products listed on our website are subject to availability. We generally have all items in stock for next day delivery, however occasionally there may be a small delay whilst more stock is acquired. You will be informed of any delays once your order is placed or on request via email. 1.2. We aim to provide any colour requirements stated with an order. Sometimes due to stock availability issues we cannot fulfil these requirements. In this case an alternative colour will be posted. If this is not satisfactory, and you wish to return the item it will be subject to a restocking charge. 1.3. We accept orders that are placed online or via telephone to our customer services department. Visa/Mastercard/Maestro/Switch/Solo payments can be taken over the phone, we cannot accept other cards over the phone. 1.4. All order forms must be fully completed, with the correct information given within each field. 1.5. The address details that you provide may be used to carry out further checks or “authorisations” with the card issuer for security purposes. In some instances a proof of identity and/or a proof of address may be requested. 1.6. Complications caused by any of the above in Clauses 1.3 - 1.5 may cause a delay in the processing and despatch of your order. Any problems encountered in clauses 1.5 and 1.6 could cause a delay in the processing and despatch of your order. 2. Payment / Ownership of Goods 2.1 We accept payment by Visa/Mastercard/Maestro/Switch/Solo through our own payment processing gateway, and Delta, Electron and Amex cards through Paypal. These options are made clear in the checkout process. 2.2 Payment is taken at time of placing the order. 2.3 Within these terms and conditions: "Promotional Product" means an item or product offered free of charge with goods that have been supplied and paid for, or discounted to free. “Goods” means all products that are offered for sale by Audio Mania and also applies to mobile phones that have been discounted or supplied free of charge on contract connections. 2.4 Goods and promotional products remain the property of Audio Mania until the goods are paid for in full. If your cardholder declines payment, whether before or after despatch of the goods to you, we will treat the order as being cancelled. If the goods and promotional products have been dispatched we may:- a) Require you to return the goods and the promotional products to us in the original condition within 7 days; or b) Require you to pay in full by satisfactory alternative means within 7 days. 2.5 Any claim or obligation under this Clause is without prejudice to our rights. 3. Website Accuracy 3.1. Audio Mania does not guarantee the accuracy of information supplied on the web site. This includes (but is not limited to) product specifications, network tariffs, call charges, product prices and special offers and promotions which may change without prior notice, before or after you have placed your order with us. 3.2. Products, prices, offers and promotions are valid only for the period they are displayed on our website (unless otherwise stated) - all of which are subject to availability. 3.3. Pictures of products are as a representation only and should be used only as a guide. Specifications and/or colours of products may change without prior notice. 4. Product Warranty 4.1. MP3 Players: Products come with a 12-month manufacturers warranty. This will only be valid with an invoice from us, which can either be printed from your account, or provided on request. If the item becomes faulty during the first 180 days, please contact us and we will arrange for the repair or replacement of the item. After this period the warranty is provided direct with the manufacturer, based abroad. We can provide you with their address and contact details on request. 4.2. Memory Cards: Products come with a manufacturers warranty, normally between 5 and 10 years. This will only be valid with an invoice from us, which can either be printed from your account, or provided on request. If the item becomes faulty during the first 28 days, please contact us and we will arrange for the repair or replacement of the item. After this period the warranty is provided direct with the manufacturer. We can provide you with their address and contact details on request. 4.3. In general all items are tested before dispatch. This is to reduce probability of unsatisfactory items being delivered. They are tested by experienced technicians and are treated with utmost care. This also allows us to check contents of packages and ensure items are advertised correctly. 5. Delivery 5.1. Packages are delivered by Royal Mail or Securicor Omega Express. Both delivery methods require a signature upon delivery. The signature of any person upon delivery shall be deemed to signify the acceptance that the goods have been received in good order. Please note that this term will stand whether or not the person signing is the actual customer. 5.2. Delivery options are presented in the checkout process, Royal Mail First Class Recorded delivery includes insurance up to £34 in the event that it is lost or damaged in the post. It is suggested that you use Special Delivery which includes insurance up to £500 for items valued at more than £34, especially during busy postal periods. Audio Mania cannot be held responsible for the loss or damage of any items whilst in transit, however we will of course provide as much help as possible in claiming compensation from Royal Mail. Compensation for Recorded Delivery items is limited to £34. 5.3. Please allow up to 15 working days for first class and first class recorded items to be delivered. If your item has not arrived within this time we will commence the procedure to claim compensation from Royal Mail. If your order is worth more than the compensation level you have paid for, you will need to pay the additional amount if you still wish to receive you item, or will receive a refund up to the compensation amount. We will dispatch replacement lost in the post items once you have returned our confirmation of items lost in the post form. We will attempt to process this form as quickly as possible and dispatch your replacement. 5.4. We do not deliver any orders outside of the United Kingdom. 6. Privacy of Information 6.1. Please see our privacy information page for more details 7. Pricing 7.1. Unless we indicate otherwise, all prices stated are the net final prices of the goods. The only additional charge to your order will be delivery cost. All Errors and Omissions are excepted. 8. The Return of Goods 8.1. Where goods become faulty within the first 14 days, the faulty items must be returned to us, with the original packaging, within 28 days from the date of Dispatch. The faulty item will automatically be replaced, unless a refund is specifically requested on the RMA form. 8.2. Where goods become faulty outside the first 14 days, the faulty items must be returned to us, with the original packaging. The faulty item will be replaced or an exchange is possible subject to stock availability and prior arrangement.
8.3. If an item is unwanted and returned within the cooling off period of 7 days from dispatch you will be entitled to a full refund for the cost of the product, excluding postage charges. It must be returned in the same condition it was dispatched with all accessories and packaging. 8.4. If an item is unwanted and returned within the extended cooling off period of 28 days from dispatch you will be entitled to a maximum of 80% of the cost of the item. It must be returned in the same condition it was dispatched with all accessories and packaging. Items cannot be returned for a refund after 28 days from dispatch. 8.5. It is the customer`s responsibility for the safe return of all goods. We suggest Royal Mail Special Delivery or Royal Mail Recorded Delivery. All items must be returned as they were received with their original packaging and full contents included, along with original documentation. Items returned in a less than pristine condition and/or with damaged or missing packaging will incur charges to cover the cost of the items. These charges will be pursued by Audio Mania. We do not refund return postage costs.
8.6. Refunds will not be given if Audio Mania judge that the product has been wilfully damaged, misused, neglected, overloaded, modified, adapted or repaired. 8.7. While we try to process all returns within 5 working days please allow up to 28 days for your return to be processed. Refunds may take up to 5 working days to display on your account. 8.8. Audio Mania Ltd accept no responsibility for the loss of data or information stored on any products or accessories returned to us. Please ensure you keep a copy of all data on products sent to us. If a product becomes corrupt or damaged and data backup is not possible we will do our utmost to recover any data, but cannot guarantee recovery. 9. Audio Mania Ltd is not responsible for any delays caused by Royal Mail. While we package all ou items securely and post them promptly occasionally items can be mislaid. Cooling off periods or allowances for returning items are measured from the date of dispatch, not the date of delivery. We do not offer special consideration for delivery delays out of our control. Items that are lost in the post will be replaced once the 15 working day period, as determined by Royal Mail, has passed. 10. Your Legal Rights as a Consumer 10.1 These Terms and Conditions do not affect any of your statutory rights. 11. Complaints 11.1.
